Please find attached a copy of legislation to amend the Wage Payment and Collection Law (Act 329 of 1961) to include public employees in its coverage. The Wage Payment and Collection Law requires that employers pay their employees for time worked on regular paydays (no more than 15 days after time worked); the problem is that this law only applies to private sector employees. Pennsylvania's Department of Labor & Industry's Bureau of Labor Law Compliance enforces this law and handles complaints.
I originally introduced this legislation as HB 2197 in the 2009/10 Session due to complaints from state employees going unpaid during budget impasses, and having to file unpaid wage claims with the federal Department of Labor under the federal Fair Labor Standards Act. I believe we need to empower the Pennsylvania Department of Labor & Industry with the jurisdiction to investigate such "unpaid wage" claims in order that our constituents who are public employees can be better served.
I believe that this bill makes common sense and corrects a longstanding deficiency in the Wage Payment and Collection Law. Please join me to protect all employees' wages in the Commonwealth!
