Unlawful Use of Unmanned Aircraft

No later than May 4th, I will introduce a bill to regulate unmanned aircraft, more commonly known as drones. The bill contains the language of HB 1339 from last session, which represented a bi-partisan approach to the regulation of unmanned aircraft. HB 1339 passed the House by a vote of 200-0 in June 2016. HB 1339 was an amendment to the Crimes Code making it unlawful to intentionally or knowingly conduct surveillance of another in a private place by using unmanned aircraft.
In addition to the language of HB 1339, the bill contains two other prohibitions: (1) to operate unmanned aircraft in a manner which places another in reasonable fear of bodily injury; and (2) to deliver, provide, or transmit contraband to inmates in correctional institutions. Just as with HB 1339, I worked with the Federal Aviation Administration (FAA) regarding this additional language. The FAA has given states guidance regarding the areas states may regulate and the areas which are exclusively reserved to the federal government. The language of the bill has been reviewed by the FAA and meets the requirements of the federal/state dichotomy.
