In the near future, I plan on re-introducing legislation (prior HB 2647 – 17/18 Session) that will allow construction sites that result in a land disturbance of more than one but less than five acres, to apply for a waiver of an otherwise required National Pollutant Discharge Elimination System (NPDES) Permit.
The NPDES permit process puts an unnecessary financial burden on these construction sites that have very little impact on the environment. States that surround Pennsylvania comply with the NPDES waiver program that already exists at the federal level. It is unfair for Pennsylvanians all across the Commonwealth to comply with an additional regulatory scheme when they are already abiding by the restrictions the federal law mandates. This legislation will bring Pennsylvania’s NPDES program up to the same standards as the federal and surrounding state programs.
