In the near future, I plan to introduce legislation which would require retailers who sell hypodermic needles and syringes to individuals without a prescription to collect tracking data.
In 2009, the state board of pharmacy updated its regulations to allow for the dispensing of sterile hypodermic needles and syringes to individuals who did not have a prescription. At the time the regulation was promulgated, numerous entities expressed concerns on the lack of tracking information which was required to be collected at the time needles and syringes were dispensed over-the-counter.
After consultation with local pharmacists, I have crafted legislation which will fundamentally mirror the requirements for the dispensing of pseudoephedrine over the counter. That is an individual must be over the age of 18 and must show a valid state ID at the time of purchase. Further, the legislation will require the hypodermic needles and syringes to be kept behind the counter and dispensing to be limited to 100 needles or syringes at a time.
Numerous other states that allow for the dispensing of hypodermic needles and syringes without a prescription have substantially similar statutes or regulations. In particular Illinois, Massachusetts and California require proof of identification and validation of age as well as tracking information to be recorded.
