Authorising Use of Impact Fees for Stormwater Management

In response to rising costs for compliance with federal storm water regulations, I will be introducing a bill to allow counties to use impact fee funds on MS4 (Municipal Separate Storm Sewer System), otherwise known as storm water management. Again, this legislation will give counties the flexibility to use impact fee funds on storm water management – it does not require counties to spend the funds on storm water management.
As per Act 13 of 2012, proceeds from the impact fee are distributed to local governments and state agencies. Most recently, the Independent Fiscal Office estimated that the impact fee for CY 2018 will be $247.0 million, which is an increase of $27.4 million from the prior year. The use of impact fees is specific to certain qualifiers. My legislation would add stormwater management as one of those qualifiers.
Many counties and municipalities are being forced to increase or establish storm water fees which are imposed on our constituents. Providing counties additional flexibility to spend impact fee funds on storm water management is one way we can help counties, ultimately our constituents, alleviate the financial burden the federal regulations are imposing on the Commonwealth.
