Design Build Best Value (DBBV) is an innovative procurement method that has been used successfully in states across the country to complete infrastructure projects. DBBV minimizes risk to infrastructure owners, produces cost savings, and allows projects to be completed in record time. It is especially effective for large, complex infrastructure projects. In Pennsylvania, as the result of a 2011 Commonwealth Court decision, all contract construction work must be done solely by the lowest bidder procurement method. It is high time that we address this court decision and allow DBBV procurement in our state.
In the near future, we intend to introduce legislation to allow the Department of Transportation (PennDOT) and the Turnpike Commission to use DBBV as an alternative procurement process for infrastructure design and construction. DBBV may be used when a construction project would benefit from this procurement method because of factors such as project complexity, potential for innovation, project risks, or estimated project cost. PennDOT or the Turnpike Commission may conduct a one-step or two-step request for proposal. Public notice for request for proposals is required and the allowance of DBBV will expire in eight years unless renewed by the General Assembly. An expiration date will ensure that this procurement method is revisited and necessary changes made.
