The Contractor Registration Law is intended to protect consumers. If a contractor is convicted of defrauding a customer, they can no longer register as a contractor and they cannot legally run a contracting business in PA. When a contractor accepts a down payment and then does not perform the work or starts the work but never finishes the job, it hurts consumers. The law no longer allows people like that to own contracting businesses in PA.
There is nothing in the current law which stops that person’s spouse from starting a contracting business and hiring their spouse who was convicted of fraud to manage the business and do 100% of the actual work. Nothing in the law precludes a person who was convicted of fraud from making quotes and accepting down payments while working for another contracting business.
I will soon introduce legislation to close this loophole and better protect consumers.
