In the near future, I plan to reintroduce SB 751 and SB 753 of last session that will allow the child welfare system to put protections in place for newborns who are found with illegal controlled substances in their systems.

SB 751 – Amends Title 42, the Juvenile Act, to include a newborn who receives a diagnosis of fetal alcohol syndrome or tests positive for any amount of an illegal controlled substance under the definition of “dependent child.”

Previous Co-sponsors included Senators:  WARD, PILEGGI, BROWNE, EARLL, FOLMER, ORIE, WASHINGTON, BOSCOLA, FONTANA, FERLO and BREWSTER

SB 753 –Amends Title 23, the Child Protective Services Law, by changing the definition of “child abuse” to include incidences where a child tests positive at birth for an illegal controlled substance.
